Constitutionalism, both as theory and practice has been most commonly defined as the idea that the exercise of arbitrary power of the state needs to be restrained. This definition however cannot exhaust the meaning of constitutionalism and can be more appropriately described as liberal constitutionalism. The literature on Indian Constitutionalism, however, emphasizes the difference of Indian Constitutionalism from the narrow concerns of Liberal Constitutionalism. The rationale of Indian Constitutionalism is not to restrain the power of the state, but rather to empower the state to bring about social transformation. The Indian Constitution: Cornerstone of a Nation. NewDelhi: Oxford Universitty Press. A Companion to Postcolonial Studies.
